Welcome to Mosite, a website monitoring web application provided by Barnsley Services Ltd and developed and maintained from the UK. By using our service, you agree to comply with the following terms of service. If you do not agree to these terms, you may not use Mosite.

The service includes features such as uptime monitoring, error tracking, and performance metrics. Barnsley Services Ltd reserves the right to modify or discontinue the service at any time without notice.

User Conduct

By using Mosite, you agree to comply with all applicable laws and regulations. You also agree not to use the service for any unlawful or abusive purposes. Specifically, you agree not to:

Payment and Billing

Your subscription will automatically renew each month on the anniversary of your signup date. You can change your plan or cancel your subscription at any time by visiting the billing section of your Mosite account dashboard. Please note that cancellations will take effect at the end of your current billing period.

Disclaimer of Warranties

Limitation of Liability

If a users' account is suspended as a result of Barnsley Services Ltd, all data relating to the user will be removed from the system.

Governing Law and Jurisdiction

These terms of service shall be governed by and construed in accordance with the laws of England and Wales, and any disputes arising out of or in connection with these terms of service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Service Level Agreement (SLA)

  • Uptime Guarantee: Barnsley Services Ltd strives to maintain an uptime of 99.5% for Mosite. This excludes downtime caused by scheduled maintenance, force majeure events (as defined below), or outages resulting from customer equipment or internet connectivity issues.
  • Response Times: Barnsley Services Ltd will use commercially reasonable efforts to respond to support tickets within 24 hours during business hours (Monday-Friday, 9:00 AM to 5:00 PM GMT).

Data Security and Privacy

  • Data Security: Barnsley Services Ltd implements industry-standard security measures to protect user data and website information collected through Mosite. These measures include secure data storage, access controls, and regular security audits.
  • Data Retention: Barnsley Services Ltd will retain user data for as long as necessary to provide the Mosite service and comply with applicable laws. Users can request to have their data deleted by contacting Barnsley Services Ltd.

  • Technical Support: Barnsley Services Ltd offers email-based technical support to paying subscribers during business hours (Monday-Friday, 9:00 AM to 5:00 PM GMT).

Free Trial/Refunds

  • Free Trial: Barnsley Services Ltd may offer a free trial of Mosite with limited features for a duration of 14 days. Users are required to provide a valid payment method to activate the free trial, but no charges will be incurred unless the user chooses to subscribe to a paid plan at the end of the trial period.
  • Refunds: For paid subscriptions, Barnsley Services Ltd offers a full refund within 30 days of purchase if the user is not satisfied with the service. After 30 days, no refunds will be granted.

Additional Considerations

  • Term and Termination: Paid subscriptions to Mosite have a minimum term of one month. Either party can terminate the subscription with 30 days written notice. Force Majeure: Neither party shall be liable for any delay or failure to perform its obligations under these Terms of Service due to causes beyond its reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, strikes, or governmental regulations.
  • Dispute Resolution: In the event of a dispute arising from these Terms of Service, the parties shall attempt to resolve the dispute amicably through negotiation. If the parties cannot reach an agreement, the dispute shall be settled by binding arbitration in accordance with the rules of a reputable arbitration organization.

Barnsley Services Ltd reserves the right to modify these terms of service at any time, without notice. It is the responsibility of users to review these terms periodically for any changes. By continuing to use Mosite after any such changes are made, users agree to be bound by the modified terms.
